1) Scope

1.1 These Terms and Conditions (hereinafter “T&C”) apply to all contracts for the delivery of goods concluded between GALLERY WORLD, a sole proprietorship based in Graz, Austria (hereinafter “Seller”), and consumers (hereinafter “Customer”) via the Seller’s online shop operated on the Shopify platform.

1.2 A consumer within the meaning of these T&C is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

1.3 Deviating terms and conditions of the Customer shall not apply unless expressly agreed to in writing by the Seller.

2) Conclusion of Contract

2.1 The product descriptions displayed in the Seller’s online shop do not constitute binding offers, but rather an invitation to the Customer to submit a binding offer.

2.2 By completing the order process and clicking the order button, the Customer submits a binding offer to purchase the goods contained in the shopping cart.

2.3 The contract is concluded when the Seller accepts the Customer’s order by sending an order confirmation by email or by dispatching the goods.

2.4 Order processing and communication usually take place by email. The Customer must ensure that the email address provided is correct.

2.5 These Terms and Conditions are available in German and English.

3) Right of Withdrawal

3.1 Consumers generally have a statutory right of withdrawal.

3.2 Detailed information on the right of withdrawal, the withdrawal period, and any exclusions can be found in the Withdrawal Policy, which forms an integral part of these T&C.

4) Prices and Payment Conditions

4.1 All prices stated are final prices in Euro (€).

4.2 In accordance with the Austrian small business regulation pursuant to § 6(1)(27) of the Austrian VAT Act (UStG), as amended with effect from 1 January 2025, no VAT is charged or shown.

4.3 Any additional shipping costs are displayed during checkout before the Customer completes the order.

4.4 The following payment methods are available:

PayPal
Bank transfer (if available at checkout)

5) Delivery and Shipping Conditions

5.1 Delivery is available exclusively to:

Austria
Germany

5.2 Processing time is 1–3 business days.
Estimated delivery time is 7–9 business days.

5.3 For deliveries to countries outside our country of business, customs duties, import taxes, or other import charges may apply. These costs must be borne by the customer. Currently, we only ship to Germany (DE) and Austria (AT).

5.4 If delivery fails for reasons attributable to the Customer, the Customer shall bear the resulting costs.

5.5 Self-collection is not possible.

6) Retention of Title

The goods remain the property of the Seller until full payment of the purchase price has been received.

7) Warranty (Liability for Defects)

7.1 The statutory warranty rights apply.

7.2 For personalized or custom-made products, returns due to dissatisfaction are excluded.

7.3 Customers are requested to report obvious transport damage without delay. This does not affect statutory rights.

8) Liability

8.1 The Seller shall be liable without limitation in cases of:

intent or gross negligence
injury to life, body, or health
mandatory statutory liability

8.2 In the case of slight negligence involving a material contractual obligation, liability is limited to the foreseeable damage typical for the contract.

8.3 Any further liability is excluded to the extent permitted by law.

8.4 We are neither the owners of the brands depicted in our products nor are we affiliated with them. As enthusiasts, our intention is solely to appreciate and showcase the beauty and diversity of culture. If any brand owner does not wish their brand to be featured, we kindly ask that you contact us so we can promptly arrange for its removal.

9) Applicable Law

These T&C are governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the country of their habitual residence.
